Medical Certificates

  • Issuance may be restricted for anyone other than the patient.

Article 13-2 of the Enforcement Rule of the Medical Service Act (Requirements for Access to Medical Records, etc.)

1. Pursuant to Article 21, Paragraph 1 of the Medical Service Act, a patient who wishes to view or receive copies of their medical records must present an identification document verifying their identity (e.g., Resident Registration Card, passport, driver’s license, or government employee ID with a photo).


2. Under Article 21, Paragraph 2, Subparagraph 1 of the Act, if the request is made by the patient’s spouse, lineal ascendants or descendants, or the spouse's lineal ascendants (hereinafter referred to as "family members"), the following documents must be submitted:

  1. An identification document of the applicant (e.g., Resident Registration Card, passport, driver’s license, or government employee ID with a photo)

  2. A document proving family relationship, such as a certificate of family relations or a copy of the Resident Registration

  3. A written consent form (Form No. 29) personally completed and signed by the patient


3. Under Article 21, Paragraph 2, Subparagraph 2 of the Act, if a representative designated by the patient requests access or copies of the patient’s medical records, the following documents must be submitted:

  1. The identification document as specified in Paragraph 2, Item 1

  2. The consent form as specified in Paragraph 2, Item 3

  3. The patient’s certificate of registered seal (Inkan Certificate)


4. Under Article 21, Paragraph 2, Subparagraph 3 of the Act, if the patient’s family requests access or copies of the patient’s medical records in a situation where the patient’s consent cannot be obtained, one of the following documents must be submitted in lieu of the consent form:

  1. If the patient is deceased: a document proving death, such as a certificate of family relations or a certificate of removal from the family register

  2. If the patient is unconscious: a medical certificate verifying the patient's unconscious state

  3. If the patient is a minor: a document proving minority status, such as a certificate of family relations

  4. If the patient is legally incompetent: a certified copy of the court’s decision on guardianship or a psychiatric diagnosis confirming incompetency by a psychiatrist
